The January 2012 Update to LBTN Includes the Following:
JUDICIAL COUNCIL FORM CHANGES
- SUBP-002 - has been renamed "Civil Subpoena (Duces Tecum) for Personal Appearance and Production of Documents, Electronically Stored Information, and Things at Trial or Hearing and Declaration" and revised to reference ESI and to remind the user that they may specify the format in which ESI is to be produced. (See Chapter 7)
- CIV-120 - "Notice of Entry of Dismissal and Proof of Service" has been revised to include electronic service. (See Chapter 8)
- EJ-130 - "Writ of Execution" has been revised to conform to the January 2011 changes to C.C.P. §699.520 relating to the legal entity of the judgment debtor and designating whether the case is limited or unlimited. (See Chapter 9)
CODE CHANGES
- C.C.P. §437c has been revised to add new subsection (s). Generally, motions for summary adjudication ("MSA") are only to be granted where they will completely dispose of a cause of action, affirmative defense, a claim for damages, or an issue of duty. However, parties may now stipulate to bringing MSA’s that do not do so. (See § 6.7.2.)
- Government Code §70616 has been revised to clarify that one $550 complex case fee covers all plaintiffs. (Appendix "F")
MISCELLANEOUS
- On 12/15/11 the Orange County Superior Court issued an Administrative Order requiring documents in breach of contract actions commenced after 1/1/12 to be eFiled.
- In October of 2011 the Los Angeles Superior Court developed a set of Voluntary Efficient Litigation Stipulations meant to encourage cooperation between the parties and to assist in resolving issues in a manner that promotes economic case resolution and judicial efficiency. We’ve added reference to them throughout the book and a new Appendix "G" with more information.
AUTHOR’S TWEAKS AND IMPROVEMENTS (Highlights only)
- Throughout the book: Added that deadlines are extended per C.C.P. §12a(a) if they fall on a holiday or weekend and added C.C.P. §1010.6 extensions everywhere C.C.P. §1013 extensions are mentioned.
- Disclaimer page: Added the url to access the list of courts’ Limited Service Days.
- Chapter 1: Revised calendaring boxes to clarify the deadline for filing request for entry of default.
- Chapter 1: Added the exceptions to filing the Civil Case Cover Sheet.
- Chapter 1: Clarified that the Statement of Damages is required for entry of default.
- Chapter 3: Revised and supplemented the entire chapter. We now suggest obtaining reject sheets/checklists from the court due to differences in procedure. Added more detail on obtaining default judgment, the need to dismiss other defendants, and more.
- Chapter 6: Revised discussion re telephonic appearances and added the applicable fees.
- Chapter 6: Various revisions and additions in light of C.C.P. §437c changes, including mandatory language for notice of motion.
- Appendix B - Revised the table on B-2 to reflect the Orange County Superior Court Administrative Order re eFiling breach of contract actions.
- Appendix G - New! About the VELS with links to and summary of each stipulation.
Free Access to Changes to the Companion
We have also made minor edits to California Civil Litigation and Discovery (the "Companion") and published a 5th Edition. The only change in the Companion that is not also in the LBTN Update concerns the increase in the jurisdictional limit in Small Claims Court.
