Calendaring-related errors are the leading cause of malpractice, especially in California, where calculating a single deadline requires several steps and the application of many different codes and rules.  AbacusLaw, a rules-based computerized calendaring program, does your calendaring for you.

All you have to do is enter the triggering event (e.g., filing a complaint, serving a complaint by a particular method, setting a hearing on a motion, serving a response to rogs, setting of an initial trial date), and the AbacusLaw CA Rules add-on automatically:

  • Applies the court rule or code section applicable to the particular triggering event (e.g., if you are served with rogs, it applies C.C.P. Section 2030.260 to tell you that the response is due in 30 days).
  • Applies C.C.P. Section 1013 to increase the response time, or C.C.P. Section 1005(b) to increase the notice time, depending upon the method of service.  So, if rogs are served on you by mail, it adds 5 days to your response time; if they are served by fax, it adds 2 court days.  If you enter a hearing date, it will tell you the last day to serve notice by mail, last day to serve by fax ....
  • It warns you when the date falls on a court holiday, so you can move the response date to the next court day or move the notice of motion, opposition or reply date backwards. 

For example:

  • Enter the date the complaint was filed, and it will automatically calendar the last day to file proof of service of summons. 
  • Enter a hearing date, and it will automatically enter the last day to serve the notice by mail, fax, overnight delivery, last day to serve the opposition, last day to serve the reply, last day to submit the proposed order, last day to object to the proposed order .... 
  • Enter the day answers to rogs were served, and it will automatically enter the last day to serve a motion to compel further responses, and remind you to meet and confer beforehand. 
  • Enter the initial trial date, and it calendars all the dates which are triggered, including discovery cut-off, last day to demand exchange of expert witness lists, last day to serve a motion for summary judgment, and much more.
